06 Case No: 087211 J - DADE COUNTY - JUDGE LINDSEY - February 2008
Facts: My client was found sleeping in his vehicle on SR 826. After waking him up and making generic DUI observations, the trooper gave him roadside tests and he blew .151.
Result: I filed a motion to dismiss based on the fact that the officer had no right to wake my client up. The trooper only made the DUI observations after he ordered my client out of the vehicle. Also, based on the reports, the trooper did not have enough time to watch my client for the 20 minutes from the time the trooper left the scene and the time my client gave a breath sample. On the day of trial the State dismissed the DUI.
07 Case No: 05019594 MM10A - BROWARD COUNTY - JUDGE COWART - February 2008
Facts: My client was sleeping in his car on Pine Island Road in Plantation. The officer told my client he had to do the roadside tests and was read Miranda before being asked to take a breath test which he refused.
Result: The arresting officer was arrested herself in Orlando last year. I filed a motion to suppress the refusal based on the Confusion Doctrine and a motion to exclude the roadsides based on the misstatement of law from the officer, the State dismissed the DUI.
08 Case No: F 07045639 - DADE COUNTY - JUDGE PRESCOTT - February 2008
Facts: My client allegedly stole the headlight off another car and then was involved in a car accident one block away. When the officer looked in his wrecked car he saw the stolen headlights. He was not arrested then because the victim had not reported the crime yet.
Result: If my client completes 50 hours of community service, the State will dismiss the charges.
09 Case No: 8793 XCM - DADE COUNTY - JUDGE NEWMAN - January 2008
Facts: My client was stopped for having her radio too loud on Miami Beach. She was offered roadside tests which she failed and blew .164.
Result: I filed a motion to dismiss based on the stop. The officer has to hear the loud music at a certain distance from the vehicle . At trial the State dismissed the DUI charge.
10 Case No: 07 023341 CF10A - BROWARD COUNTY - JUDGE DIJOLS - January 2008
Facts: My client allegedly had a dispute outside his house. He allegedly went into the house and brought a gun outside and waved it around. He was charged with aggravated assault with a fire arm which carries a minimum 3 year jail sentence.
Result: All charges were dropped.
