6 Case No: 08-9130-MM10A 3rd DUI - BROWARD COUNTY - JUDGE COWART - Jun 2009
Facts: My client was stopped at the off ramp at 595 and Nob Hill Road. He had fallen asleep at the light and paramedics were called. When the paramedic banged on his window he woke up. On my clients lap was a half empty beer bottle. Davie police officer's Berardo, Paquet and Sullivan arrived. My client had slurred speech and fell out of the car. He refused a breath test.
Result: When I took the paramedics deposition he told me that he took the keys out of the car when he arrived for safety. I filed a motion to dismiss based on the fact when the officer's arrived they could not arrest my client since they never saw him driving the vehicle and he didn't have possession of the keys. The State dismissed the DUI.
7 Case No: 07 27524 MM10A - BROWARD COUNTY - JUDGE BERMAN - May 2009
Facts: My client, a medical student, was stopped for driving 30 mph in a 35 mph zone and her windows were to dark. I filed a motion to attack the stop on the basis that it is not illegal to drive 5 mph under the speed limit and the officer is not allowed to pull a car over for the dark tint.
Result: My client will be able to complete medical school without a criminal conviction. The DUI was dropped.
8 Case No: 0030-31-BBC - DADE COUNTY - JUDGE ORTIZ - May 2009
Facts: My client was pulled over for failure to maintain a single lane by officer Franco. He observed bloodshot eyes,slurred speech and odor of alcohol. She flunked the roadside tests and took a breath test.
Result: I filed numerous motions attacking the stop and the roadsides. I explained to the State that if no cars had to take evasive action and the officer didn't suspect impairment from alcohol then I would win the stop motion. State offered a reckless driving.
9 Case No: 5440 -XDG - DADE COUNTY - JUDGE ARZOLA - Apr 2009
Facts: My client was stopped leaving the Homestead Speedway after the NASCAR races. The officer wrote that my client almost hit him with his car. He failed the roadside tests and refused the breath test.
Result: I filed numerous motions. One motion dealt with the fact that the officer who stopped my client was not in his jusrisdiction, he was a Key West deputy that came to Dade County to help out with the race. I explained to the State that this deputy had no authority to stop my client and the case was dismissed.
10 Case No: 5991-xdc - DADE COUNTY - JUDGE NEWMAN - Apr 2009
Facts: My client was involved in a car accident in Coral Gables. Officer Rodriquez arrested him after he failed roadside tests and he blew .133.
Result: On the day of trial, the victim involved in the accident did not properly identify my client as the one in the accident and based on the motions I filed, the State was forced to dismiss all charges.
