1 Case No: 08-19366 MM10A 2ND DUI - BROWARD COUNTY - JUDGE COWART - Dec 2011
Facts: This was my clients 2nd DUI and she was detained by officer Smith of Hallandale PD after he saw her car stuck on the train tracks.
Result: Since she was out of the car when the officer arrived and there was no accident or damage to the car or tracks the State could not prove all the elements of the DUI and the DUI was dismissed.
2 Case No: 11-11880MM10A 2ND DUI - BROWARD COUNTY - JUDGE FRYE - Dec 2011
Facts: This was my clients 2nd DUI and the State was asking for 30 days in jail. He was stopped by deputy Berman and arrested by DUI TASC Force deputy Kelliher. He was also charged with a Prior Refusal to take the breath test.
Result: After taking all the depositions in this case I had a meeting with the Chief DUI State Attorney in this division to explain the problems with the case. The video was better than the deputy reported about the roadsides and the stop was for illegal tint. The officer did not have probable cause to stop for this. The case was reduced to Reckless Driving
3 Case No: 10-25559 MM10A - BROWARD COUNTY - JUDGE GOTLIEB - Dec 2011
Facts: My client was stopped for speeding by trooper Baker. He failed the roadside tests and refused to take a breath test.
Result: I argued several motions attacking the recollection of the trooper and the words used to offer the roadside tests and the breath test. After 4 hours of arguing these motions the State dismissed the DUI case and offered a Reckless.
4 Case No: 2795 XDP 2ND DUI - DADE COUNTY - JUDGE MIRANDA - Nov 2011
Facts: This was my clients 2nd DUI in 2 years. The State asked for 30 days in jail and a 5 year License Revocation. My client was stopped by officer Pinillos of North Miami Beach PD and arrested by officer Maya. She blew 3 times the legal limit .256
Result: I filed numerous motions attacking the stop, roadsides and breath test. Officer Maya testified that he did the 20 minute observation while he was driving her from the scene to the jail. He also misstated the law on the roadside tests. The State dismissed the case.
5 Case No: 09-27624 MM10A 3RD DUI - BROWARD COUNTY - JUDGE COWART - Oct 2011
Facts: My client was involved in an accident, DUI TASC force deputy Buttery made the arrest and my client blew .158
Result: The case took over 3 years to resolve because of breath test motions. The State was asking for 180 days in jail and no driving for 10 years. After arguing all the motions and the State realizing the weakness of the case, the case was reduced to Reckless Driving and my client didn't go to jail or lose his license for 10 years.
