Case No: 09-1714-MM10A 4TH DUI - BROWARD COUNTY - JUDGE IRELAND - Nov 2009 |

Facts: My client who has 3 prior DUI's was facing a permanent revocation of his driver's license and one year in jail if he lost this case. He was stopped by deputy D'Esposito for driving with unsafe equipment, his left headlight was damaged and facing the street. Deputy Mohammed was called to handle the DUI investigation. He admitted to four beers and refused the roadside tests and refused the breath test. |

Result: When I took the deposition of the second deputy, he told me that the left headlight was out and there was no light at all. I also filed a motion based on the fact the first officer didn't have enough DUI evidence to call in the DUI expert. On the day of the motions, the DUI expert, the State and myself worked out a plea to a reckless driving with no permanent license revocation. |

Case No: 09-4205-MM10A - BROWARD COUNTY - JUDGE SIMON - Oct 2009 |
|
Facts: My client was stopped for running a stop sign. When officer Wollard made contact with him, he smelled marijuana in the vehicle and could see some in the door side pocket of the vehicle. The vehicle was searched and the officer found the marijuana. |

Result: My client never made any statements admitting the marijuana was his and the police officer never finger printed the bag it was found in. The State offered pre-trial diversion and the case will be dropped. |

Case No: 09-11844-MM10A - BROWARD COUNTY - JUDGE IRLEAND - Aug 2009 |
|
Facts: My client was given a ticket for DWLS. Based on the fact that he has several prior DUI's and several prior DWLS the State offered 6 months in jail. |
|
Result: Deputy Estrada went to my client's house and asked my client if he was the person who was towing a car down his street with another car, because the car being towed hit and damaged a mailbox. A witness had written down the tag and it came back to my client. My client admitted to the officer that it was him and he was charged with DWLS. I filed a motion to suppress his admission because without his confession, the State had no case. At the motion the State dismissed the case. |

Case No: 08-21200-MM10A - BROWARD COUNTY - JUDGE LERNER-WREN - Jul 2009 |
|
Facts: My client ran a red light and was stopped by deputy Grady. He failed roadsides and refused the breath test. |
|
Result: I filed numerous motions and the deputy no longer works for police department. The case was dismissed. |

Case No: 08-17241-MM10A - BROWARD COUNTY - JUDGE ROBINSON - Jun 2009 |
|
Facts: My client was stopped leaving Gatsby's in Davie by officer Arndt and was given roadsides by officer Williams. When she exited her vehicle, her shorts were unbuttoned and unzipped and she told the officer's that she was drunk and began crying. She flunked all tests and refused the breath test. |

Result: In deposition. the officer testified that he only had recollection of her shorts being unzipped, but had no recollection of the rest of the investigation. He testified the same in front of the judge during the motions. The State dismissed all charges. |
